A Palm Bay man faces up to five years in prison after he was charged
Wednesday with illegally operating a pirate Haitian radio station
from the back of his music business.

Jean Robert Dominique, 41, was charged with the third-
degree felony after a complaint to the Federal Communications
Commission, which oversees radio and television transmissions.

The station operated at 90.9 megahertz on the FM dial as Radio
Antilles. It played Caribbean music and broadcast in Creole.

"He had a little studio with a homemade transmitter, an audio mixer
board and a 43-foot tower. He even had advertisers. He just didn't
have an FCC license," Palm Bay police spokeswoman Yvonne Martinez
said.

Hiram Octave Grandoit, spokesman for nonprofit corporation CVP, said
the group plans an AM station, called the "Caribbean Voice of Palm
Bay," in the same plaza. Dominique was not associated with CVP
group, Grandoit said.

Dominique has an occupational license to operate a business named
Island Music and Promotions at 1510 Palm Bay Road, but not a radio
station.

His broadcast interfered with public radio station WMFE at 90.7 FM
and with Harris communications.

FCC spokeswoman Rebecca Fisher said stations with more than 10 watts
require a license. For low-wattage stations, such as the station
operated by Dominique and WCPB, there is an application window for
various bands on the dial.

"Then they must go through a process of approval," she said.

The Rev. Jonas Philistin, pastor of the New Birth Church, said the
pirate station was popular.

Grandoit said it is important to have a radio station to inform the
growing Caribbean community in Palm Bay. They received city
permission back in January for a tower, but the city wouldn't give
them an occupational license without an FCC check to make sure it
wouldn't bleed into other frequencies.

"We wanted to be legal, so the FCC engineer is coming down in June
to recheck everything," Grandoit said. "We get calls every week
asking when we'll be on."

Last month, Florida Department of Law Enforcement confiscated
equipment from the corner of a tailor shop in Delray Beach, where
police also gave warnings to operators of two other unlicensed radio
stations.

It is against the law, so what you want them to do?
I would understand you better if you had said taht those guys could apply for a low power radio? haitians do not get along well. They could have leased a normal radio station for 24 hours or 12 hours? So, they will not do it because they will fight along the way.
I know a guy, lesley jacques, who leases a radio station by himself in Miami.
So, if that what they have to do, they know the consequences, do it!
However, i will not blame them.

This is a perfect example of the "cleanup" that needs to happen. We all understand the situation but you must also realize that this has nothing to do with Haitians. It's an illegal practice that was shut down. There is nothing else to it. Celestin, you are right, they know the consequences, so do it legally! But no, they still try to beat the system. So sa yo pran se pa yo! Same goes to bootleggers. You KNOW you are doing something illegal, so don't cry or look for the public's pitty when you get shut down. All I can say is Happy Trails and enjoy your consequences.

Neg Jacmel, why is my name even mentionned in your silly post. I guess it is another of your lame attempts to undermine the authority!

Now, let's discuss "ILLEGAL" like you mentioned. A large majority of Haitians came to this country ILLEGALY. As a result most of them have these days the opportunity to send their children to school and to have a better life. I'm pretty sure you ARE among this category. Now, does that make it WRONG ???
